Seller Terms and Conditions

1. BE SUPPORTIVE & KIND

In order to promote a healthy and supportive community and marketplace, we expect our sellers to be kind and communicate in a supportive and non-discriminatory manner with customers, vendors, experts and owners of BikeFitterSupply.com.

The following behaviour is therefore not permitted:

1. No personal attacks

2. No “calling out” (identifying someone you are claiming to have breached the terms of use)

3. No racist, sexist or hateful content or rants

4. No spam or promotion of other competitor services

5. No vulgarity or swearing

6. No “trolling”

7. No defamation of others

8. No bringing Bike Fitter Supply into disrepute

If anyone is found to be behaving in ways described above, their shop may be suspended or deleted, and their content removed.

2. BE RESPONSIBLE FOR YOUR OWN SUCCESS

We challenge you to immerse yourself in everything that’s on offer through your Online Shop, BFS support and the ‘How To’ videos. BFS is here to empower you to create and grow your business by accessing a niche but growing market. We can advise and support you, but ultimately creating sales and running your business is in your hands. Creating products and services is only part of the process, networking, promoting and running a business etc are all important too. You will find lots of helpful topics in our ‘How to’ videos.

3. BE RESPECTFUL

Please don’t use BikeFitterSupply.com to promote products for sale cheaper on other platforms (e.g. your own website). Please support the site by shouting loud and proud about Bike Fitter Supply (you are of course welcome to sell anywhere). Do not link to your own website or other selling platform either in your shop, product listings or posts/comments. Bike Fitter Supply’s primary purpose is a marketplace to sell your items from our website and must not be used as a lead generation or marketing tool to direct customers elsewhere. You can however add your social network links to build your following in your shop settings. 

If selling to fellow Bike Fitter Supply vendors, all sales must go through the Bike Fitter Supply website.

Do not use the Bike Fitter Supply website, community or social media accounts to entice our sellers to join another selling platform or your own marketplace.

4. PROHIBITED ITEMS FOR SALE

1. Products which infringe copyright or trademark 

2. Adult or pornographic products 

3. Hazardous or dangerous products (weapons, knives, chemicals, nicotine etc)

4. Products gained illegally or stolen

5. Illegal items (e.g. drugs)

6. Food, Toys or Cosmetics without the necessary license

5. PRODUCT SAFETY REGULATIONS

Sellers must comply with the relevant product legislation in their country of origin.

6. SELLING FEES

Listing Fees – ZERO (unlimited products, no end date)

Membership Fee – ZERO 

Commission Fees – 12%

Order Payment Transaction Fees – Stripe: 2.9% + 30c per order.*

*Additional fees may be applicable for pay outs from BFS into a non-US$ currency (additional 1%) or for orders paying with non-US cards (additional 1%).

7. YOUR FUNDS

You will receive your funds immediately after your customers purchase, into your Stripe account. Stripe will automatically transfer funds to your bank account 7 days later, or in accordance with your Stripe settings.

8. POSTAGE

The BFS platform automatically calculates shipping fees based on your ship-from address and the customer’s ship-to address. These figures are calculated live using your own UPS and/or FedEx accounts. The calculated shipping amount is taken at checkout and passed over, in full, to you.

There is a 3.5% buffer built into the shipping fee to cover card processing fees.

You are responsible for posting items to customers directly. This must be within the time frame specified in your shop settings and/or listing. If, for whatever reason, you are unable to do so, you must inform your customer and email andy@bikefittersupply.com within 48 hours.

9. PACKAGING

No additional fees are added for packaging. Please account for this when pricing your product as it cannot be added to the shipping fee.

10. RETURNS / EXCHANGES / REFUNDS / REPAIRS

By using our service, all sellers agree to abide by the relevant Consumer Protection Regulations for their region and the region of the buyer (where appropriate). These laws protect the consumer when buying online. Bike Fitter Supply make it easy for sellers to comply by providing a returns policy template, however, compliance to the relevant distance selling law is the responsibility of the seller. 

11. CUSTOMER DATA AND PRIVACY

To run a shop on BikeFitterSupply.com you must have a Privacy Policy added to your shop settings. If you need help to create one, we have provided a privacy policy template. If selling into the EU, please be aware that you will need to use a privacy policy that complies with GDPR standards.

You must only use customer data for purposes of posting their orders.

You must not collect customer data without their express consent.

You must not contact customers for any purpose other than to update them on orders or respond to their messages.

12. YOUR INTELLECTUAL PROPERTY

All content uploaded to Bike Fitter Supply remains your intellectual property. Your content (photos, product names, descriptions, downloads, audio and video) must be your own and not owned by others unless you have a license to do so. By uploading to the site you are giving rights and license for Bike Fitter Supply to use, edit, modify and make available to the public, your content, for your benefit, to market your business and your products/services. This will be for (but not limited to) both online and offline publications (for example: adverts, blog posts, social media posts, marketing materials, press releases, magazines, newspapers, books etc) with the sole purpose of helping you gain more business. 

Your content must not infringe any law and indemnifies Bike Fitter Supply against all legal fees, damages and other expenses that may be incurred as a result of your breach of the above. 

13. OUR INTELLECTUAL PROPERTY

You must not copy or modify Bike Fitter Supply trademarked branding, or other content from the site, without our express consent.

While selling on BFS you have authority to add our ‘Available on BFS’ badge to your website and other media. However, if you decide to leave or we sadly have to remove you for breaking these terms you will be expected to remove any BFS branding from your site and other media. Previous social posts can remain. 

14. OUR LIABILITY

Bike Fitter Supply.com will not be liable for:

  • Loss of data
  • Loss of revenue or profits
  • Loss of sales or opportunities
  • Loss of goodwill or reputation

15. CANCELLATIONS BY YOU

There is no tie-in preventing you from leaving, and you can cancel your vendor account at any time.

16. CANCELLATIONS BY US

Bike Fitter Supply reserve the right to remove any product listings or delete your account and content without notice at any time if you violate the above Terms. In most cases we will endeavor to give you notice unless we acknowledge that your actions or content may be harmful. Bike Fitter Supply reserves the right to terminate or change the service for any reason at any time without notice.

17. UPDATES TO OUR TERMS

From time to time we will update our seller terms which will be posted here online. Please review these terms regularly to ensure you are aware of any changes. Your continued use after changes are updated means you agree to be legally bound by these terms.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

Who we share your data with

We only share your data with the relevant vendor. This data is shared with the sole purpose of fulfilling your order and providing regular communication along the way. Vendors are asked not to use your private information for any other reason and any vendor found doing so will be removed from the site.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
